1. Agreement

This End User License Agreement ("EULA") governs your use of HomeHealth TX software, websites, mobile applications, and related services (the "Software"). By installing, accessing, or using the Software, you agree to this EULA. If you use the Software for an agency or organization, you represent that you are authorized to do so.

2. Intended Use

The Software supports private-pay personal assistance services (PAS), non-skilled home care coordination, scheduling, visit documentation, family visibility, caregiver workflows, and agency administration. The Software is not a medical device and does not provide medical advice, diagnosis, care decisions, clinical decision support, insurance claims submission, or payer billing.

3. License

HomeHealth TX grants you a limited, non-exclusive, non-transferable, revocable license to use the Software only for its intended purpose and only as permitted by your role, account permissions, this EULA, and any applicable agency subscription or order terms.

4. Agency Terms and App Store Terms

Commercial access, subscriptions, fees, implementation, support, and account administration are governed by the applicable agency subscription, order form, or service terms. For iOS applications, Apple's standard Licensed Application End User License Agreement applies where required by Apple, in addition to this EULA to the extent not conflicting.

5. User Responsibilities

• Use the Software only with accurate account information and authorized credentials.
• Protect login credentials and promptly report suspected unauthorized access.
• Enter care coordination, scheduling, and visit information accurately.
• Comply with applicable laws, agency policies, and assigned permissions.
• Do not use the Software for skilled nursing, medical documentation, payer claims, or interoperability workflows unless expressly supported in a separate written agreement.

6. Restrictions

You may not copy, modify, reverse engineer, resell, sublicense, scrape, interfere with, or attempt to bypass security controls in the Software. You may not upload malicious code or use the Software to violate another person's rights or applicable law.

7. Ownership and Feedback

HomeHealth TX and its licensors own the Software, including related intellectual property. You retain rights to information you or your agency submit, subject to the rights needed for HomeHealth TX to operate and support the Software. Feedback may be used without obligation to you.

8. Privacy

HomeHealth TX handles personal information as described in the HomeHealth TX Privacy Policy. Agency-controlled care information remains subject to the applicable agency's policies, instructions, and agreements.

9. Updates and Availability

HomeHealth TX may update, modify, suspend, or discontinue features from time to time. Some features may require internet access, supported devices, current app versions, or active agency authorization.

10. Disclaimers and Liability

The Software is provided "as is" and "as available" to the maximum extent permitted by law. HomeHealth TX disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. HomeHealth TX is not liable for indirect, incidental, special, consequential, or punitive damages. Any liability is limited as provided in applicable agency subscription or order terms, or otherwise to the maximum extent permitted by law.

11. Termination

Your license ends when your account is terminated, your agency's access ends, or you stop being authorized to use the Software. Upon termination, you must stop using the Software and remove mobile apps from personal devices if applicable.
